Welcome to redlionsurgicenter.com (the “Site”), operated by Red Lion Surgicenter (“Red Lion,” “we,” “us,” or “our”). These Terms of Use (“Terms”) govern your access to and use of the Site and any content, features, or services made available through it. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Site.

1. Not medical or dental advice

The Site is for general informational and educational purposes only.

Nothing on the Site is intended to be, or should be taken as, medical or dental advice, diagnosis, or treatment for any individual person.

3. Online forms, messages, and accounts

The Site may allow you to request appointments, submit contact forms, pay bills, sign up for messages (including SMS), or access patient portals or similar features.

You agree that any information you provide through the Site will be accurate, current, and complete, and that you will update it as needed.

You are responsible for maintaining the confidentiality of any login credentials associated with the Site or any linked portals and for all activity that occurs under your credentials.

We reserve the right, in our sole discretion, to refuse, suspend, or terminate your ability to use any part of the Site or any account or feature at any time, with or without notice, for any reason or no reason.

Note: Submitting information through general contact forms is not a substitute for direct communication with our office or your provider and may not be monitored in real time. Do not use the Site to communicate urgent or emergency information.

SMS Terms and Conditions: By opting in to receive SMS messages from Red Lion Surgicenter (“Red Lion SMS Program”), you agree to receive text messages from Red Lion Surgicenter related to appointment reminders, appointment confirmations, scheduling updates, post-visit follow-ups, billing or account notifications, and other customer care or operational communications. Message frequency may vary depending on your interactions with Cavity Busters, your appointments, and your account activity.  Message and data rates may apply. To get help, reply HELP to any message or contact us at redlion@cavitybusters.com or 215-676-2232. To opt out, reply STOP to any message. After you send STOP, you may receive one final message confirming your opt-out. Carriers are not liable for any delayed or undelivered messages. Your use of the Red Lion Surgicenter SMS Program is also subject to our Privacy Policy at https://www.cavitybusters.com/privacy-policy.

4. Privacy; HIPAA

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and disclose information about users of the Site. By using the Site, you consent to our information practices as described in the Privacy Policy.

As a healthcare provider, we may collect, create, or maintain protected health information (PHI) as defined by HIPAA in the course of providing care to patients. Our use and disclosure of PHI is governed by our separate Notice of Privacy Practices, not by these Terms. If you are a patient, please refer to that Notice for details about how we handle PHI and your related rights.

5. Intellectual property

The Site and all content on it—including text, graphics, logos, icons, images, videos, audio clips, designs, layouts, software, and other materials (collectively, the “Content”)—are owned by Red Lion Surgicenter or our licensors and are protected by copyright, trademark, and other intellectual property laws.

Except as expressly allowed by these Terms or by written permission from us:

You may access and view the Site and Content only for your personal, non‑commercial use.

You may not copy, reproduce, modify, adapt, translate, create derivative works from, publish, display, transmit, distribute, sell, license, or otherwise exploit any part of the Site or Content.

You may not remove, alter, or obscure any copyright, trademark, or other proprietary rights notices appearing on the Site or Content.

“Red Lion Surgicenter,” “Red Lion,” our logos, and any other practice names or marks that appear on the Site are trademarks or service marks of Red Lion Surgicenter. Other marks and logos on the Site may be the property of their respective owners.

If you submit or upload any content to or through the Site (for example, comments, suggestions, reviews, or other materials), you represent and warrant that you have the right to do so and that such content does not infringe or violate the rights of any third party.

Unless we specifically state otherwise in writing, you grant Red Lion Surgicenter a non‑exclusive, royalty‑free, worldwide, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media, for any lawful purpose, subject to applicable privacy and patient‑confidentiality laws.

We may, but have no obligation to, monitor, review, or remove any content submitted to or through the Site, in our sole discretion.

7. Third‑party links and services

The Site may contain links to or integrations with third‑party websites, services, platforms, or tools (for example, payment processors, patient portals, social media platforms, or mapping services).

These third‑party sites and services are not controlled by Red Lion Surgicenter, and we are not responsible for their content, security, or privacy practices.

Inclusion of any link or integration does not imply endorsement or recommendation by Red Lion Surgicenter.

Your use of third‑party sites and services is entirely at your own risk and subject to the separate terms and privacy policies of those third parties.

8. No warranties

THE SITE AND ALL CONTENT AND SERVICES AVAILABLE THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE FULLEST EXTENT PERMITTED BY LAW, CAVITY BUSTERS AND ITS OWNERS, DENTISTS, PROVIDERS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:

THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR‑FREE; DEFECTS WILL BE CORRECTED; OR

THE SITE OR THE SERVERS THAT MAKE IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL RED LION SURGICENTER OR ITS OWNERS, DENTISTS, PROVIDERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SITE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID (IF ANY) TO USE THE SITE, WHICHEVER IS GREATER.

SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY FOR CERTAIN TYPES OF DAMAGES, SO SOME OR ALL OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless Red Lion Surgicenter and its owners, dentists, providers, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of or access to the Site;

Your violation of these Terms; or

Your violation of any rights of another person or entity.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with us in asserting any available defenses.

11. Changes to the Site and to these Terms

We may modify, suspend, or discontinue any part of the Site at any time, with or without notice, and we will not be liable to you or to any third party for doing so.

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. If we make material changes, we may also provide additional notice (such as posting a prominent notice on the Site).

Your continued use of the Site after any changes to these Terms have been posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

12. Governing law and dispute resolution

These Terms and your use of the Site are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict‑of‑laws principles.

Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Philadelphia county, Pennsylvania, and you consent to the personal jurisdiction of such courts, unless applicable law requires a different venue or forum.

13. Termination

We may, in our sole discretion, suspend or terminate your access to all or part of the Site at any time and for any reason, including for any violation of these Terms, without prior notice or liability.

Upon termination, your right to use the Site will immediately cease. The provisions of these Terms that by their nature should survive termination (including, without limitation, ownership provisions, warranty disclaimers, limitation of liability, and indemnification) shall survive.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

15. Entire agreement

These Terms, together with our Privacy Policy and any other legal notices posted on the Site, constitute the entire agreement between you and Red Lion Surgicenter regarding your use of the Site and supersede any prior or contemporaneous understandings, agreements, representations, or warranties, whether written or oral, with respect to the Site.
